BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned Browndell Drive located northwest from Brown's Ferry Road, southwest of Mountain View Drive, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: Browndell Drive, a 50 foot wide unopened right-of-way beginning on the northwest line of Brown's Ferry Road 210.5 feet southwest of the intersection of the northwest line of Brown's Ferry Road with the southwest line of Mountain View Drive (as relocated), thence southwest some 50 feet to the intersection of the southwest line of Browndell Drive with the northwest line of the Interstate 24 right-of-way, thence northwest 170 feet with the southwest line of Browndell Drive to the southeast line of Mountain View Drive (as relocated), thence northeast some 50 feet with Mountain View Drive to the northeast line of Browndell Drive, thence southeast 178 feet with Browndell Drive to the northwest line of Brown's Ferry Road, the point of beginning. Said street separates part of lot 29 from part of lot 30, Terrace Heights Subdivision, as shown by plat of record in plat book 16, page 86, ROHC. Tax Map No. 144N-A-12, and 144N-B-18. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The reservation for the Tennessee-American Water Company of an easement the width of the right-of-way for the purpose of operating and maintaining their facilities located within the right-of-way. 2. Reservation of an easement the width of the right-of-way for South Central Bell for the purpose of operating and maintaining its facilities in said right-of-way. 3. The areas reserved for utility easements must be kept free and clear of all structures. 4. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
